Acceptable use policy

1. About us

   1. www.sportforgood.org is a site operated by Laureus World Sports Awards Limited on behalf of the Laureus Sport for Good Foundation ("we", "our", "us"). We are registered in England and Wales under company number 3822952 and we have our registered office at 15 Hill Street, London, W1J 5QT. Our VAT number is GB 751 8171 30.

   2. This Acceptable Use Policy sets out the terms between you and us under which you may access and upload content on our website www.sportforgood.org ("our site"). This Acceptable Use Policy applies to all users of, and visitors to, our site.

   3. Your use of our site means that you accept, and agree to abide by, all the policies in this Acceptable Use Policy, which form part of our Terms and Conditions of Use and privacy policy for our site ("Terms").

2. Prohibited uses

   1. You may use our site only for lawful purposes. You may not use our site:

      1. in any way that breaches any applicable local, national or international law or regulation or in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

      2. for the purpose of harming or attempting to harm minors in any way;

      3. to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards at paragraph 4 below;

      4. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);

      5. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

   2. You also agree:

      1. Not to reproduce, duplicate copy or re-sell any part of our site in contravention of the provisions of our Terms.

      2. Not to access without authority, interfere with, damage or disrupt:

         1. any part of our site;

         2. any equipment or network on which our site is stored;

         3. any software used in the provision of our site; or

         4. any equipment or network or software owned or used by any third party.

3. Interactive services

   1. We may from time to time provide interactive services on our site, including, without limitation:

      1. Chat rooms.

      2. Bulletin boards.

      3. accepting postings from external social networking sites ("interactive services").

   2. Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

   3. We will do our best to assess any possible risks for users from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

   4. We will archive User Generated Content and the archive will be made available to site visitors for a period of up to 12 months and for up to 12 months on its server or as may otherwise be required by law.

   5. We collect data relating to your use of the interactive services, such data being automatically provided when you log-on. We use our best efforts to store any such data securely and it is accessible only to authorised Laureus and/or affiliate companies' personnel.    6. The use of any of our interactive services by a minor (anyone under the age of 18) is not permitted and you must not use our interactive services if you are under the age of 18

   7. We will not intentionally or knowingly hold any personal data belonging to a minor. When we become aware that a minor has registered with us, we will delete the registrations and associated personal data of that minor. We will also remove the registrations of a minor at the request of the minor's parent(s).

   8. Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

   9. You must provide and continue to provide a valid email address in order to access any interactive services.

4. Moderation

   1. Interactive services are fully moderated. User Generated Content submitted to us will be checked by us for compliance with our content standards in paragraph 6 below, before it is published. We will try to publish as much User Generated Content as we can but we cannot guarantee that all User Generated Content will be published. We also cannot guarantee how quickly User Generated Content will be posted as this will depend on other editorial commitments.

   2. Although our interactive services are fully moderated, we are under no obligation to you or any other person to oversee, monitor or moderate the interactive services or any other service we provide on our site and we may stop moderating the interactive services at any time. We reserve the right to reject, remove, or to disable access to, any User Generated Content which we deem to be potentially defamatory of any person or which we deem unlawful or in violation of any third party rights or not in accordance with the content standards set out in paragraph 6 below. We expressly exclude our liability for any loss or damage arising from the use of the Board by any person in contravention of these Rules.

   3. Laureus accepts no responsibility for the opinions and information posted on the forum by users. Laureus disclaims all warranties with regard to information posted on the interactive services. In no event shall Laureus be liable for any special, indirect or consequential damages, or damages of any kind whatsoever, resulting from loss of use, data or profits, arising out of or in connection with the use or performance of any information posted on the forum.

5. Submission of user generated content

   1. To add User Generated Content, including a new thread for discussion to our site, please enter your comment, send an email or click a link when appropriate.

   2. Whilst we will try to upload User Generated Content promptly, we are under no obligation to upload any User Generated Content, either within any particular timescale (whether you have indicated such a timescale or not) or at all.

   3. We reserve the right to limit the length of any User Generated Content that we accept, or the amount of User Generated Content that we accept from any single contributor.

   4. All User Generated Content is subject to the Content Standards set forth in paragraph 6 of this Policy.

6. Content standards

   1. These content standards apply to any and all material (including, but not limited to, comments, photographs, text, musical works, works of authorship, messages, chat, files, images, video, sounds or any other materials) which you contribute to our site ("User Generated Content"), and to any interactive services associated with it. For content standards that apply to content provided by us please see the Terms and Conditions of Use.

   2. You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any User Generated Content as well as to its whole.

   3. User Generated Content will only be accepted on the basis that it is submitted under a Creative Commons Licence (Attribution Non-Commercial No Derivative Works 2.0 UK: England & Wales) ("Creative Commons Licence") and you must not submit any User Generated Content if you do not agree to this.

   4. The terms of the Creative Commons Licence mean that you can copy, distribute, display or perform User Generated Content located on our site subject to the following conditions:

      1. Attribution: you must always give credit to the original author;

      2. Non-Commercial: you may not use any User Generated Content for any commercial purpose;

      3. No Derivative Works: you must not alter, transform or build upon any User Generated Content; and

      4. You must ensure that any reuse or distribution of User Generated Content is on terms identical to this Creative Commons Licence.

   5. Any of the conditions of the Creative Commons Licence may be waived if you get the permission of the copyright holder.

   6. Nothing in the Creative Commons Licence impairs or restricts the moral rights of any User Generated Content author.

   7. Nothing in the Creative Commons Licence affects your fair dealing and other rights.

   8. Contributions must:

      1. be courteous and patient with other contributors;

      2. be accurate (where they state facts);

      3. be genuinely held (where they state opinions);

      4. comply with applicable law in the UK and in any country from which they are posted;

      5. be original or must contain all necessary acknowledgements, services, references and citations.

   9. Contributions must not:

      1. be used to impersonate any person, or to misrepresent your identity or affiliation with any person;

      2. contain any personal information;

      3. contain any offensive, infringing, defamatory or otherwise inappropriate user names;

      4. be in capital letters (which are equivalent to shouting);

      5. contain any URLs that we have not approved;

      6. give the impression that they emanate from us, if this is not the case;

      7. contain any material which is defamatory of any person or infringe any copyright, database right, trade mark, or any other intellectual property right of any other person.

      8. contain any material which is obscene, offensive, hateful or inflammatory;

      9. promote sexually explicit material, violence, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or advocate, promote or assist any unlawful act;

      10. be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

      11. be likely to deceive any person or harass, upset, embarrass alarm or annoy any other person;

      12. be threatening, abusive or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.

7. Suspension and termination

   1. We will determine, in our discretion, whether there has been a breach of this Acceptable Use Policy and/or Terms and Conditions through your use of our site. When a breach of either of these policies has occurred, we may take such action as we deem appropriate. We may also take down any information when requested to do so by a third party who considers that a breach of their rights has occurred.

   2. Failure to comply with this Acceptable Use Policy constitutes a material breach of the Terms upon which you are permitted to use our site, and may result in us immediately suspending your right to use our site (temporarily or permanently) and/or taking legal proceedings against you for reimbursements of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

   3. We exclude liability for actions taken in response to breaches of this Acceptable Use Policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

8. Changes to the acceptable use policy

   1. We may revise this Acceptable Use Policy at any time by amending this page. You must check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this Acceptable Use Policy may also be superseded by provisions or notices published elsewhere on our site.

9. Jurisdiction and governing law

   1. The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site, our Terms or this Acceptable Use Policy although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country, and English law will be the governing law.
